  • This website is operated by PCBWay. Throughout the site, the terms “we”, “us” and “our” refer to PCBWay. PCBWay is comprised of different legal entities including PCBWay,PCBWay.com,PCBWay.es,PCBWay.jp,PCBWay.fr. These Terms are issued on behalf of each of these companies and their affiliates, so when we mention “PCBWay,” "we", "us" or "our" in these Terms, we are referring to the relevant PCBWay entity.PCBWay offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
  • Uploading weapons or parts subject to export control regulations such as ITAR, EAR beyond EAR99, or EU Dual Use is a violation of our terms of use; "by the way We do not manufacture and don't accept Production product such as various weapons and equipment and military equipment."

    By placing an order through the PCBWay website, the customer agrees to be bound by these Terms of Service and acknowledges that such order placement shall be deemed as the formation of a legally binding contract between the customer and PCBWay.

SECTION 1.1 - ONLINE STORE TERMS
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

1). Account creation. In order to use certain features of the Site, You must register for an account (“Account”) and provide certain information about Yourself as prompted by the account registration form. You represent and warrant that: (a) all required registration information You submit is truthful and accurate and (b) You will maintain the accuracy of such information. You may delete Your Account at any time, for any reason, by following the instructions on the Site. We may suspend or terminate Your Account in accordance with these Terms.
2). Account Responsibilities. You are responsible for maintaining the confidentiality of Your Account login information and are fully responsible for all activities that occur under Your Account. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of Your Account or any other breach of security. We cannot and will not be liable for any loss or damage arising from Your failure to comply with the above requirements.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
You represent and warrant that all information You submit to the Site is accurate and truthful and that You have the full right and authority to provide us with all User Content, documentation, drawings and specifications, and You are authorized to grant the license referred to in Section 11.
SECTION 3 - Trade Compliance
3.1 You warrant that the products you entrust us to manufacture and the products you obtain from us will be disposed of and used,exported, re-exported, and transferred domestically in strict compliance with all applicable export control and economic sanctions laws, regulations, and executive orders, including but not limited to China's Export Control Law, Regulations on the Export Control of Dual-Use Items, and the U.S. Export Administration Regulations (EAR).
3.2 You represent and warrant that neither you nor any of your subsidiaries, affiliates,direct or indirect shareholders (including ultimate beneficial owners) is subject to sanctions or restrictions under the sanctions laws, regulations, or executive orders of any country or region in the world (including but not limited to China, the United States, the European Union, and the United Kingdom).Nor are you owned 50% or more, directly or indirectly, individually or in the aggregate, or otherwise controlled by one or more such sanctioned subjects.
3.3 You represent and warrant that you, your subsidiaries, affiliates, joint venture partners, directors, senior management, employees, and authorized representatives have complied with and will continue to comply with all provisions of export control and economic sanctions laws and regulations, including but not limited to the relevant laws, regulations, decisions, directives, and orders issued by China, the United States, the European Union, the United Kingdom, the United Nations, and other countries or regions.
3.4 You represent and warrant that your counterparties (including suppliers, cargo carriers, research and development partners, project partners, contract manufacturers, distributors, intermediaries, customers, end-users, etc.) are not subject to sanctions or restrictions under the sanctions laws, regulations, or executive orders of any country or region in the world (including but not limited to China, the United States, the European Union, and the United Kingdom).
3.5 You further warrant that you will not, in any way (including but not limited to transfer, lease, authorization, resale, etc.), circumvent or transfer the products supplied by us to:
(a) any restricted party on applicable sanctions lists or any party subject to restrictions under relevant sanctions policies;
(b) prohibited or restricted high-risk regions, including but not limited to Cuba, Iran, North Korea, Syria, Russia, Belarus, Donetsk, Luhansk, Crimea, and other regions(specifically subject to the lists formally published by relevant trade control laws); or
(c) restricted end-uses, including but not limited to military end-uses, military intelligence end-uses, weapons of mass destruction, nuclear uses, or uses involving human rights violations.
3.6 We shall have the right to require you to provide end-user statements, end-use certificates, copies of export licenses, or other compliance documents reasonably requested by us before or at any time during the transaction.
3.7 If you are suspected of violating this clause or refuse to cooperate with our reasonable review requests, we shall have the right, without assuming any liability, to immediately suspend performance, terminate this Agreement, or take other remedial measures.
3.8 If your breach of any representation, warranty, or obligation under this clause results in us suffering any economic losses (including but not limited to legal costs), fines, penalties, or reputational damages, we shall have the right to claim full actual damages from you.

We do not provide standalone component sales. All components are procured exclusively from authorized distributors on a project basis and are used solely for assembly in customer PCBA orders.
SECTION 4 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 5.1 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
PCBWay strives diligently to maintain up-to-date and precise details regarding products and pricing, yet cannot warrant complete accuracy or timeliness of such content. Quoted prices may be adjusted without prior notice until final order confirmation by PCBWay. The price shown in the web-form on entering the order will be binding only upon confirmation and after the submitted documentation files have been checked. PCBWay reserves the right to change the price or cancel the order if the documentation submitted does not comply with the data entered in the order input screen. In such instances, we will notify you the changes. Should an order be nullified post-payment, PCBWay ‌will refund through the original payment method‌.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 5.2 - Surcharge Policy
If you select the Import VAT or Customs Duty service on our order settlement page, the associated taxes will be included in the order settlement, and the subsequent tax fees will be borne by our company. If you choose the Import One Stop Shop (IOSS) service for the European Union on our order settlement page, the order settlement will include the value-added tax (VAT), and the subsequent VAT fees will be borne by our company.
Description of the charges for the extra charges of the website other than the product price:
Logistics fee: When your product needs logistics service, need to charge the corresponding logistics fee.
Bank fee: When you accept the purchase of goods from PCBWay, you may need to pay an extra fee of varying proportion to PCBWay when you use your debit card or credit card to pay. PCBWay is used to pay the fee of a third-party payment company.
VAT: When you are an EU country and need the VAT service of IOSS, you may need to pay the corresponding VAT, VAT = VAT rate (VAT rate of each EU country) ×(CIF price+import tariff)
Tariff: When you need DTP(Duty Tax Paid) service, it will generate corresponding DTP service fees and corresponding import duties and other taxes.
DTP service fee: the operation fee required when paying customs duties on behalf of DHL service.
DHL Express Billing Services
DHL Express offers door-to-door transportation services and various Duties & Taxes Billing Services independent of the Incoterms® indicated on the commercial invoice.
One such service is the Duty Tax Paid (DTP) Billing Service, available independently from the Incoterm® indicated on the Commercial Invoice. DHL pays applicable import duties and taxes to local customs authorities and then invoices the shipper's account. This ensures that the receiver is not approached for payment upon delivery, creating a positive customer experience.
Receivers:
Be aware that once the shipper requests DHL to bill import duties and taxes to a specific account, the receiver will not be charged upon delivery.
DHL may contact receivers for necessary information or clarification to clear shipments, regardless of the Incoterm® used.
SECTION 5.3 - Customs and Import taxes
You may be charged customs duties and taxes for something you bought on PCBWay because:
• Duties and taxes are typically not included in the price of the item, and might not be included in the overall shipping costs you pay to us.
• When ordering on PCBWay, you are buying from overseas manufacter. That’s why sometimes you will be asked to pay customs duty.
The taxes may depend on where your order was sent from, the type of items you bought, their value and the weight of the package. Different countries may have different tax policies regarding specific products. It’s always best to confirm this with your local customs authority or the sales-rep.
You are responsible to clear VAT on all purchases made on PCBWay. This can be done through the VAT clearance procedure of your local customs authority in your country of residence.
Please note: Customs duties and taxes are never covered by PCBWay.
To avoid any unforeseen surprises, please pay attention to the following:
• Contact your local post or customs office to find out more about your country’s customs duties and taxes.
• Import duties, taxed or other customs-related charges are normally collected by the shipping company upon delivery.
• PCBWay is not responsible for delays caused by the customs department in your country.
• Additional costs or delays may occur during international trade. CPT - Carriage Paid To
CARRIAGE PAID TO (CPT) means that the seller delivers the goods – and transfers the risk - to the buyer by handing them over to the carrier contracted by the seller or by procuring the goods so delivered. The seller may do so by giving the carrier physical possession of the goods in the manner and at the place appropriate to the means of transport used. Once the goods have been delivered to the buyer in this way, the seller does not guarantee that the goods will reach the place of destination in sound condition, in the stated quantity or indeed at all. This is because risk transfers from seller to buyer when the goods are delivered to the buyer by handing them over to the carrier; the seller must nonetheless contract for the carriage of the goods from delivery to the agreed destination.
DDP - Delivered Duty Paid
DELIVERED DUTY PAID (DDP) means that the seller delivers the goods to the buyer when the goods are placed at the disposal of the buyer, cleared for import, on the arriving means of transport, ready for unloading, at the named place of destination or at the agreed point within that place, if any such point is agreed. The seller bears all risks involved in bringing the goods to the named place of destination or to the agreed point within that place. In this Incoterms rule, therefore, delivery and arrival at destination are the same.
SECTION 6 - PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 6.1 - Buyer confirms receipt timeout
Buyer Confirmation Timeout: It refers to the buyer's responsibility to confirm receipt within the delivery time specified by PCBWay, starting from the moment PCBWay announces the complete shipment. During this period, PCBWay will communicate with the buyer in a timely manner regarding the receipt of the goods. If there is ongoing communication with the buyer and it is confirmed that the goods have not been received, PCBWay may extend the buyer's receipt time. However, if the buyer fails to confirm receipt and does not apply for a refund, the order will be considered as a buyer confirmation timeout, meaning it will be deemed as successfully received and the transaction completed. PCBWay collaborates with reliable international logistics providers such as DHL, FedEx, UPS, OCS, and others. Orders are typically prioritized for shipment by air. In general, 99% of orders are successfully delivered. The automatic confirmation time for receipt varies depending on the chosen logistics method: For logistics methods like DHL, SF, FedEx, OCS, USPS, the automatic confirmation time is usually 30 days from the shipment of the order. For logistics methods like Global Standard Shipping, EMS, PostNL International Mail, E-packet, as well as air and sea freight shipments, the automatic confirmation time is typically 60 days from the shipment of the order. For other logistics methods not mentioned, PCBWay's automatic confirmation time is usually 60 days from the shipment of the order. This means that once PCBWay successfully ships the order, the buyer has 60 days to confirm receipt. If the buyer fails to do so, the system will automatically complete the receipt process. This process ensures timely settlement and provides the buyer with sufficient time to inspect the goods.
SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Your submission of personal information through the PCBWay is governed by our Privacy Policy. The ownership of the file you uploaded remains yours, the design will remain your sole intellectual property.
License. By providing User Content to PCBWay, You grant PCBWay an irrevocable, non-exclusive, perpetual, royalty-free, fully paid up, worldwide, transferable and sub-licensable right and license to use, copy, modify, reproduce, distribute and display the data (including 3D CAD Data, 2D technical drawings PCB files, Assembly files and Electronic related documents), documentation, drawings and specifications in Your User Content, and to grant sublicenses of the foregoing rights, solely for the purposes of (1) providing the Site and all information, recommendations and/or services provided to You on or through our Site and (2) to improve our products and services, improving our machine learning and pricing algorithms. You hereby irrevocably waive (and agree to cause to be waived) any claims and assertions of moral rights or attribution with respect to Your User Content.
Publicity. By creating an account on the Site, You authorize PCBWay to use Your trademarks, logos, names or signs for marketing purposes. This means that PCBWay may mention You as a customer of PCBWay on our Site and in other promotional material such as advertising, press releases, interviews, promotional materials or presentations. We will not use Your name if You are a natural person, and the substantive content provided by You continues to be governed by the confidentiality clauses in these Terms.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. You agree to indemnify, defend and hold harmless us and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO A MAXIMUM OF THE AMOUNT PAID BY YOU TO US UNDER THE ORDER UNDER WHICH THE LIABILITY AROSE. THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR SUPPLIERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THESE TERMS.

The language of arbitration shall be in Chinese. The arbitration award shall be final and binding upon both parties.
